These Terms and Conditions regulate access to, booking of, and participation in nautical charter services provided by Islander Balearic Charter SL (hereinafter, “the Company”). By making a reservation, payment, or boarding the vessel, the client declares having read, understood, and fully accepted these Terms.
The Company operates in compliance with Organic Law 3/2018 on Personal Data Protection and Digital Rights (LOPDGDD), Regulation (EU) 2016/679 (GDPR), and Law 34/2002 on Information Society Services and Electronic Commerce (LSSICE/LSSI). Services are available only to legal entities and individuals aged eighteen (18) years or older with legal capacity to contract.
1. IDENTIFICATION OF THE SERVICE PROVIDER
Pursuant to Law 34/2002, the service provider is Islander Balearic Charter SL, Tax Identification Number (CIF) B70646146, with registered address at Bisbe Sastre 3, piso 2, 07011 Palma, Spain. Contact may be made via telephone at +34 672 684 345 or by email at info@islanderacht.com. Communications made through these channels shall be considered legally valid.
2. SUBJECT OF THE CONTRACT AND NAVIGATION AREA
The Company provides private recreational sailing yacht charter services aboard the vessel “Islander” within the Bahía de Palma. Routes and anchoring points are limited to this area. Possible destinations are shown on the website under “Destinations” and may change due to weather, sea state, safety, maritime traffic, maritime authority instructions, or protected marine zone regulations. The number of stops is not guaranteed and depends on weather conditions and charter duration, typically ranging from one (1) to four (4), at the captain’s discretion. Charters are offered as Full Day (8 hours), Half Day (4 hours), and Sunset (2.5 hours). Duration is calculated from departure from port until return. Only services expressly confirmed in writing are included.
3. CAPACITY AND SAFETY REGULATIONS
For maritime safety and legal compliance, the maximum number of passengers permitted on board is nine (9). No exceptions shall be made. The captain may deny boarding without refund if this rule is breached. Guests may be required to remove footwear onboard for safety and to protect the vessel.
4. PRICES, PAYMENT, AND FUEL
The published price represents the full cost of the charter. Fuel consumption under normal cruising conditions is included. No additional mandatory onboard charges apply. Optional services such as extra food, beverages, or special requests may incur additional costs if expressly requested.
A deposit of fifty percent (50%) of the total price is required at booking via the website. The remaining fifty percent (50%) shall be paid onboard prior to departure. Failure to complete payment may result in cancellation without refund.
5. SCHEDULES AND DELAYS
Charters begin and end strictly at the agreed time. Duration is calculated from departure until return to port. Late arrival does not entitle clients to additional time or compensation.
6. CANCELLATION POLICY
This policy applies exclusively to charters operated aboard the sailing yacht Islander.
The Company may cancel due to technical or safety reasons beyond its control. Clients will be offered rescheduling at no cost or a full refund. No further compensation applies.
Clients cancelling 48 hours or more before departure receive a full refund. Cancellations within 48 hours and no-shows are non-refundable.
Weather cancellations are determined solely by the captain. Normal sailing conditions do not qualify. Cancellation applies only when at least two of the following occur: waves over 1.5 m, winds over 30 knots, or heavy rainfall over two hours. If departure is impossible and rescheduling is not feasible, a full refund is issued.
7. CONDUCT, ALCOHOL, AND SAFETY
The captain may deny boarding or terminate the charter without refund if a guest is under the influence of alcohol or drugs to an extent that may compromise safety. Unsafe, aggressive, or illegal behavior may also result in immediate termination without refund.
Swimming, snorkeling, or entering the water is permitted only with the captain’s authorization and at the guest’s own risk.
Children must be supervised at all times by their accompanying adult. The crew does not provide childcare services.
8. DAMAGE TO THE VESSEL
The client shall be financially responsible for any damage to the vessel, equipment, or furnishings caused by negligence, misuse, or failure to follow crew instructions.
9. INSURANCE AND PERSONAL BELONGINGS
The vessel holds legally required Personal Accident and Third-Party Liability insurance. The Company assumes no responsibility for loss, theft, or damage to personal belongings onboard or during embarkation or disembarkation.
10. MEDICAL CONDITIONS
The captain may deny boarding to individuals whose medical or physical condition may pose a risk. If declared in advance, a full refund applies; if not, no refund applies. Guests must inform the Company of allergies or serious medical conditions and carry required medication. The captain is trained in First Aid only.
11. NAVIGATION SAFETY CAMERA
The vessel may use a navigation camera solely for maritime safety and monitoring of the surrounding nautical environment. It is not intended for recording passengers and is not used for surveillance purposes.
12. FORCE MAJEURE
The Company shall not be liable for failure or delay due to events beyond its reasonable control, including natural disasters, authority restrictions, government actions, strikes, emergencies, or port closures.
13. ASSUMPTION OF RISK AND WAIVER
Sailing involves inherent risks. All adults must sign a liability waiver before boarding. Boarding is not permitted without it.
14. DATA PROTECTION
Personal data are processed solely for service management in accordance with applicable data protection laws.
15. APPLICABLE LAW AND JURISDICTION
These Terms are governed by Spanish law. Disputes fall under the courts of Palma de Mallorca.
16. ACCEPTANCE
Booking and payment constitute full acceptance of these Terms and Conditions.
